These Terms & Conditions ("Terms") govern your use of the FM Landscapes & Design website (fmhardscapes.com), our services, and our text messaging program. By using our website or providing your information to us, you agree to these Terms. Please read them carefully.
1. Our Services
FM Landscapes & Design provides landscape and hardscape design and installation services, including patios, walkways, retaining walls, outdoor kitchens, fire features, and full yard renovations. Information about our services on this website is provided for general informational purposes and does not constitute a binding offer or contract. A project begins only when you and we sign a written agreement.
2. Estimates & Quotes
Estimates we provide, whether verbal, by email, or by text message, are preliminary and based on the information available at the time. Final pricing is confirmed in a written proposal before any work begins. We may adjust pricing if the scope of work, site conditions, or material selections change.
3. Design Consultations
Free design consultations include an on-site property assessment, a design concept, a material recommendation, and an estimate. Designs provided are the intellectual property of FM Landscapes & Design (see Section 5) and may be kept by you whether or not you proceed with a project.
4. Warranties
Work we perform is covered by the warranty described in your written agreement and in our project documentation. Our standard warranty includes a 2-year workmanship warranty on materials and labor and a lifetime structural warranty on the engineered core of the project. Certain premium paver, wall block, and stone products also carry manufacturer warranties that are transferred to you. Warranties apply only to work performed by us under a written agreement.
5. Intellectual Property
All designs, drawings, renderings, plans, and other creative materials we produce are the intellectual property of FM Landscapes & Design. We grant you a personal, non-exclusive license to use the designs we provide for your own property. You may not reproduce, resell, or distribute our designs for any commercial purpose without our prior written consent.
6. SMS/MMS Text Messaging Terms
By opting in to receive text messages, you agree to receive informational and promotional text messages (SMS/MMS) from FM Landscapes & Design at the mobile number you provide. These messages may be sent using an automated telephone dialing system or our text-messaging platform.
- Consent: By providing your mobile number and opting in, you consent to receive text messages from us. This consent is not a condition of purchasing any goods or services.
- Frequency: Message frequency varies.
- Costs: Message and data rates may apply and are your responsibility. Contact your mobile carrier for details.
- Opt out: You may stop receiving text messages at any time by replying STOP to any message you receive. After we receive your opt-out request, we will send you a single confirmation and will not send further text messages except as required by law.

- Eligibility: You must be the owner of, or authorized to use, the mobile number you provide, and you must be at least 18 years old.
- Carrier liability: We and our messaging platform are not liable for delayed or undelivered messages caused by your carrier or network conditions.
7. Limitation of Liability
To the maximum extent permitted by law, FM Landscapes & Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of our website, our text messaging program, or our services. Our total liability for any claim shall not exceed the amount you paid us for the services giving rise to the claim. Nothing in these Terms limits rights that cannot be limited by law.
8. Third-Party Services
Our website and chat widget may rely on third-party providers (such as our messaging and customer-relationship platform). We are not responsible for the privacy or security practices of third parties, and your use of third-party services is subject to their own terms and policies.
9. Governing Law & Disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be resolved in the state or federal courts located in Cobb County, Georgia, and you consent to the exclusive jurisdiction of those courts. Nothing in this section prevents us from seeking injunctive or other equitable relief in any court of competent jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
